Tracy Morgan Accident Lawsuit Update

Page Six reports that lawyers are meeting in federal court today in Tracy Morgan's lawsuit against Wal-Mart. He is suing the large chain for punitive and compensatory damages. Morgan will not be present for the scheduling conference.

    1. Back in September his lawyer said he had a traumatic brain injury and was having to go through speech, cognitive, and physical therapy. I hate to say something like this, but this lawsuit will likely net him more money than the rest of his career would have.

  4. Tracy getting money for lost income, pain and suffering is good. I also hope this makes WalMart put people ahead of profits,but I'm not holding my breath.

  5. Dude is missing the boat not suing the NJ Turnpike authority and their contractors. For a road where most traffic is doing 75-80MPH, the warning signs for construction and lane closures were shit.

    I've made the same mistake in the same spot as that truck driver, I just caught it a little earlier and was driving a mini van, not a rig, so I had better visibility of the cars around me and shorter breaking distance. You blow past the first sign, not noticing it, then next thing you know, you are slamming the breaks because the traffic is at a stand still beyond where they had the second warning sign.

    1. Seriously Count you always sue everyone you can in an accident like this and then if nothing pans out you drop them as parties later. Sad to say but if it turns out another party is at fault and you didn't sue them, that's negligence on the lawyer's part. You might be able to add on the other parties or you might not. Sounds like a definite contributing factor and there are usually regulations about this kind of thing be worth finding out if any were breached.

    3. I would hope that this particular site would have some close calls, but I don't feel like I'm going out on a limb to assume that there have been multiple incidents at this same spot?
      In the area I grew up, there were continuous battles to put up traffic lights at multiple sites in a rural area where crashes occurred daily. After many years of increasing incidence rates, and several dozen fatalities, the damn stop lights finally posted. And guess what? Very few accidents now.
      I could into more of a rant, but I bore easily.

    1. @dena: I bought my first when I still had a family to cart around. They are so convenient for work, when I pop the center seats out, that i'm on my second.

      I don't know if I was doing it wrong, but I hated boning on a water bed. Really hated sleeping on it.

  8. I think morgan alit more disabled by this accident than we know. As for brain injury, thats a brutal row to hoe. He should hv money put in trust, for simple fact hes admitting brain injury. As for Walmart i hate them, their stores and the shitty way they treat their help. They can well afford t sue. And truck driver shld sue for unsafe working conditions. I hate when underclass gers screwed over!

  9. For someone who is reported to be so brain damaged, Tracy has released some intelligent sounding rebuttals to Walmarts statements about the whole thing. I'm with the Count as far as - if the roads weren't clearly marked for the road construction, they hold a lot of the responsibility too. If the roads aren't clearly marked and marked far enough in advance (especially of a blind curve) sounds like the city holds some major responsibility.
