DeleteYes, I don't understand the law here. Outtie is crediting cdan when he/she posts them. I see this all the time. One site reports that another site has a story, links to it, and then lets their own commenters post on their site.
DeleteI think the problem may be that this site was initially created (arguably) as a mirror. It's since developed other sources, such as celebrity real estate, Outtie's own BIs, Outties own posts, links to non-Cdan gossip sites.
I'd love to hear a lawyer's opinion.

Just throwing idea's out, but Enty's shit site isn't the only source for blinds or perhaps blinds don't need to be the focal point of the site, it's hard to throw ideas out on here when it's clear that the Enty's are reading the content, you know? Do you have an email where we can throw you some suggestions?

You should let all the other gossip blogs know that's CDAN is bullying you with this so they'll also take down the blinds and stop linking to the site and it'll die a quick death. Nobody likes the site anymore. It's done. It's over. Other blogs reposting CDAN blinds are the only reason it's still around.

ReplyDeleteI was so happy to find the link to the Companion site after the CDAN Halloween Weekend Massacre 2014, and have enjoyed Anarchy Gossip since its debut.
Enty has no one to blame but "himself" for the massive loss of visitors. I have not returned to that site since early November, and will never go back - even if it reverted back to the original layout. I really was not visiting the old CDAN for the 'high quality' gossip & writing....it was for the commentary.
Outtie - I think your site is great. It is an interesting mix of gossip, celeb news, and open forum for the visitors. I do not come here for the CDAN links; I come here for the community. Thank you Outtie and all commenters for the great reads every day.

ReplyDeleteAmen! I used to live for Gawker, and it collapsed overnight when they changed. They used to have a fabulous site and a vibrant community of posters, and it changed overnight. I still go there once in a blue moon, but I recognize only one editor and one former commenter.

I don't know how many gossip sites repeats articles that are news not just blinds without crediting the original source or if it is coming from a press release as I suspect some of these stories are, then you should say this is from a press release.

DeleteI like the idea of reaching out to other gossip blogs that usually publish blind items (ie dlisted, blindgossip, laineygossip, acg, ontd, gossip bucket, defamer, etc.). Not necessarely to ask them to boycott CDAN but to ask for suggestions or/& support. You could also reach out to the blogger users forum for help, experience and insight.
ReplyDeletePer ex: have they faced this kind of challenge before (surely they must have), what worked and ehat didn't, how much of what you post is a copyright infringement and how you could navigate your way around, what are the precedents, etc.
A good strategy to adopt also, imo, would be to be transparent and to present your motivations as honnestly as you can...

ReplyDeleteYeah Enty is pissed. He doesn't want to admit his big mistake in the format and I actually thought other people would drift in to fill the void. I guess after the Twihards spiked his numbers he realized how much he missed us all especially from a financial aspect.
Too many companies make the mistake of forgetting how important customers actually are. Although we were buying anything we were driving up his numbers by our sheer participation. You seem to have forgotten that that was really what was important otherwise he would've long ago closed in the comments section.
But no, he really really did need us. All are bitching and all they did was to act like mother and say stop it or you'll go to bed without dinner forgetting that we were adults we could just get up and leave and go get food somewhere else. They made a grave miscalculation and rather than admit that they were wrong they're trying to stop the person that they see who took away their numbers.
I think we should all go over get that address for his tip line and tell them that Even if he stops Outtie we will never be back. And this action only more clearly illustrates how completely out of touch he is with his audience.

ReplyDeleteI know it's considerably more work than copy/paste but a slight rephrasing of blind items from "another source" may be a way to get around this. Most of Enty's blinds are so poorly written that a re-write would be a blessing. I personally would be happy with less of the obviously made up crap, reality (especially K family) and tweener stuff. Quality over quantity.

I think you should stop promoting Enty at this point. Their blinds can be read on Gossip Rocks or another site that posts all of them. Just link to that site for those specific items. You're doing a good job at defining a tone for YOUR site. I like the real estate posts. Perhaps you may want to consider asking us for suggestions as to what we want to see/read. You know, be responsive to your readership ;-)

Re-wording things, or perhaps making one "Open Gossip Forum" a day where users can post gossip/blinds from around the Web might be a good idea. The cdan companion could have just been a temporary home for everyone until he fixed the site however Enty decided to stick with his shit show of a site and be a dick and outtie branched out with anarchy gossip and now Enty is really pissed off! Too bad because even if the site were fixed, I will never go back! Not after the way he's treated outtie and his readers. We were all loyal readers, even though I rarely posted I read every damn post Enty wrote for a few years!! And I know you all did too! I loved that site and Enty has no one to blame but himself for pushing everyone away. The only time I would ever check cdan was occasionally I would check to see what people were saying over there after reading a blind on here. Usually it was a comment or two. Also, fuck the chorus of nimrods who thought that his lack of writing skills somehow meant that he was for *sure* a female writer. Enty is proof that dudes can be just as vapid, petty, and bitchy as ladyfolk.
Either way, this site is a fucking dream, and the best posters -- in my never-humble opinion -- are already here. Keep with the BG and Lainey Blinds, and toss in your own originals. You just get the ball rolling, and we'll follow it.

CDAN is dead to me. With all the ads and the impossible to read content, I'm happy to leave CDAN behind. I've been getting the blinds from AGC and come to Anarchy for the discussion. ReplyDeleteKim Jong Enty is a whiny toddler ticked that he lost a ton of traffic due to the terrible re-design. Anarchy didn't even start right after that, I believe it was a week or so later when people were tired of the 20+ ads and autoplay that couldn't be blocked and comments that "mysteriously" disappeared while - once again - nasty comments remained. Then Enty flat out lied and said "he" was reading all of the emails and they were mostly positive. BS, my email wasn't positive at all and I'm a web professional who identified the platform and even the $58 theme he was using (for those wondering, it's called TrueMag and is sold on the ThemeForest website).

I used to visit CDAN religiously, but the new site is impossible to navigate on the computer and 10x harder on my phone - which is where I typically would read it. I am so glad you started this companion site and agree with all the above comments. The articles/blind items/gossip, etc are good, but it's the people that make it great! Happy holidays everyone!

ReplyDeleteCDAN's owners are fucking up completely. Their readership traffic is revenue. The readers' comments are a vital part of the content on that site. 'Enty' has repeatedly given lip service to this fact.
Their former regulars are choosing to hang out at Anarchy instead of CDAN, since the redesign. Everyone bitched about the redesign. Yet they can't put 2+2 together to save their life.
The clever think to do would have been to announce they truly heard the complaints, blather something about how much the importance of the community, then say they are in the process of changing the site back or to a similar format as before. A Mia Culpa goes a long way. Instead, they choose to be negative, ignore their readership and then go after the site they perceived as the villain who stole their readership. They're chasing their tails instead of being smart about this. Mistakes happen. They keep compounding it and making it worse.
I had planned to pop in New Years Day to read the reveals. I won't now. I'll read the reveals on Gossip Rocks.

DeleteI quit going to CDAN immediately after the Companion site was created, because it pissed me off when the site was changed over Halloween weekend, and the CDAN Facebook page posted a notice that the format hadn't been changed and it was just everyone's computer making it look that way. DeleteI was with CDAN from the very beginning, lurker mostly, commenter occasionally. It was a small, tight community at first. I loved it at the beginning, and felt loyal even though the tone of the postings changed and it was obvious that the original blogger wasn't in command any longer- maybe a peripheral presence, but not involved in day-to-day posting, and when some of the commenters got downright nasty. But I'll never go back. And I don't feel disloyal to the original Enty; he's long gone, and was disloyal to us first. Glad to have this site available. Hope nothing ever happens to change MichaelK.
ReplyDeleteMe too Sea Hag. When I first joined Hez was the queen bee. They even held a commenters' luncheon and posted pictures. Jeez, that was years ago. I think a lot changed with the almost outing of Enty during Hmmmm thing. Nothing lasts forever and I'm thankful for Outtie's efforts to keep the crazy family together. I just can't with the new CDAN. Kim Jong Enty would be wise to join up with Outtie and come on over to the new clubhouse.

I figured last night it was another cease and desist or the like. My opinion is that this is Enty blowing smoke up your ass and trying to threaten you because he can't actually do shit. Other sites quote CDAN, the links used here are always cited, and the Enterns also risk giving up their identities in a formal suit. I would hate for you to close up shop (since I love the site and don't want Enty and his tantrums to win). But how you proceed to these threats is your choice. I would hate for you to suffer any legal consequences for the sake of our entertainment.

He be like "Oh I have this new format designed explicitly to make commenting for you easier since the commenters are a critical component of CDANs success..." to "everyone loves it STFU" to "let's blame Outtie for all my mistakes!"
I think Enty will keep coming after Anarchy so long as CDAN material is posted- this feels thoroughly personal and vindictive. I love your original posts, so maybe bulk up on those and hopefully readers can contribute tips they hear about. As you've been doing, great job with diversifying the sources of other blind items you post. If readers feel so compelled, they can write out CDAN items in the comments section. I am really pissed about this.

I like a lot of the ideas posted above (best made up blind sounds like it has GREAT entertainment potential). Enty blew any chance of getting me back by not listening to the readers and then shitting all over them for voicing an opinion (their opinions are what make the site right?). I'm here to stay Outtie. Keep doing what you do!

just throwing this out there, so feel free to totally disregard it. Maybe put up a notice that Anarchy will be shutting down for a few days due to the holidays. Outtie took a break for Turkey Day, and deserves another break anyways, right? ;)
While Anarchy is on temporary hiatus, those on board can all continue blowing up empty posts here (which we do anyways) while we boycott and give CDAN no clicks. This demonstrates to Enty et al in pure and concrete terms that ad revenue and traffic is being lost exclusively to the re-design and not because of any unfair competition, as he implies. Plus, this could potentially help Anarchy/Outtie make this case later down the line, should that ever happen (which I doubt it will).
I feel kind of bad suggesting such a thing for many reasons, but Enty is so far removed from the pulse, it worries me. I really loved CDAN and it feels like I'm going through some nasty online gossip site divorce and I hate saying this shit...but wtf Enty?!? You destroyed a forum we loved because you wanted more profits and now you're trying to shut down our alternative - on the holidays, no less.
Outtie, soon Enty will be wishing you were still citing his bullshit. Viva la Anarchy!

DeleteI'm a rare poster but long long time ex-CDAN stalwart. What Outtie is doing is amazing and it feels like here has the same atmosphere as the early Hmmn days. Even before the great change Enty had sold his soul and the site was crammed with blinds that should be criminal cases and trolling. This was a breath of fresh air.

There was no reason why he couldn't leave us alone. We weren't hurting him. To think I felt slightly bad for hardly visiting his site anymore. I've really only been going over there is to say hello to readers who sent their photos in. Now I'm not even going to do that (sorry, readers. You're great. The jerk running the site isn't.) ReplyDeleteYou know what this is really about? Reveals day. That's what this is about. It's Enty's biggest traffic day of the year. He needs this one to be a hit or it will be the beginning of the end for CDaN. If we're guessing his blinds here, he loses clicks. Honestly, I'm surprised that he's even going through with reveals day. Usually he spreads the day out with 10 lots of reader photos. Considering he's only posted 24 reader photos so far this month, he's down to 3 lots this year. He has to fill that space with more blinds - which he probably hates. I am finished with CDaN after this. I was a daily lurker, even occasional poster up until today. He just pissed that away.
Outtie, you've been amazing. I can't thank you enough for this site. You know we love you for creating it. We got your back and stand with you, lie with you, drink with you - whatever you want. Also, I love the real estate gossip. My old other favorite site, the Real Estalker, got bought by Variety and is different now.
Whoever you are, Outtie, you're awesome to take on this challenge. If you don't include any CDAN links, good! The are repeats, stale, and, frankly, it is like running into an old boyfriend when you realize your taste for him is gone. What was I thinking being in love with you? I've been a lurker for nearly ten years. I applaud Outtie and will support you no matter what. I come here everyday and will continue to do so. I come for the commenters, not the blinds. I am a terrible guesser and am amazed at how quickly some of you get these answers. I can go to AGC every couple of days and catch up on all of the blinds from all of the other sites, I don't care if I miss a made up blind here and there! I never go to cdan anymore, it is a mess and I get no enjoyment of trying to maneuver around over there, not to mention it is horrible to the eye. I really like this format and all of the little extras Outtie have given us...I love reading what's going on in everyone's little corner of the world each day, I like the real estate posts and the deep thoughts!! Anarchy is much more fun and lighthearted, with some of the most clever and commenters on any site! As someone above said, it is one of my only guilty pleasures in life and I look forward to my Anarchy time each day. Thank you for what you do and for giving us all a place to come to. This is the second time in a week I have commented, I never commented once ever over there! This feels a lot more like home.

ReplyDeleteGoogle is just doing what Google does. If Outie filed a complaint about a site using her material, Google would remove it. If anyone wants to fight the issues, then that's what the courts are for. I think commenters posting cdan blinds in the comments section could lead to all the comments being removed as well. It's still a copyright issue. Someone is allowed to decide who can publish their material and who cannot. If Enty thinks it is okay for Dlisted to post it, but not Anarchy, that is his pissy right. In this case, I think we should avoid feeding the troll and move forward, instead. Lots of sites post his blinds. For that one fix, we can go to those sites.

ReplyDeleteI read the warning, and it indicates the content is not gone, it just needs to have the "offending" material removed before we can see it again. So, I was thinking they could be reposted without the blinds attached, just titled like episodes of Friends: The one about the private dinner date. The one about the awards show. Whatever. No, we wouldn't be able to remember all the details, but we COULD retain all our comments and guesses, which, frankly, belong to THIS site and shouldn't be taken away.

DeleteKat: I only mean the ones we've already guessed at, the ones that have been removed, just so that we can preserve our comments and conversations--which belong to this site. Get rid of the borrowed blinds but allude to them by title (The one with the cheater who got cheated, etc.) just to give our guesses context. Going forward, I agree, no more from them! An all-Outtie site is all I need, because I'm here for the commenters. I just don't want to lose the conversations that have already taken place.

ReplyDeleteI am another long time lurker. I post sporadically but mostly love to read what some of the regular posters have to say. I love this site and the people who post here. Everyone gets along for the most part. Some comment sections are horrible to read, so much fighting and just people being horrible to each other. Anyway, Outie, I love the site. I haven't been to Enty's site since the changes, and whoever it is that is in charge there should be very ashamed of themselves. The cease and desist order is obviously a load of crap and was done to get back at Outie for starting this site.

On its face, I don't think you're doing anything wrong, Outtie. You are citing your sources, so it can't be considered plagiarism. If blogs and newspapers had to run purely original content, they would cease to exist. Just pick up a paper and look at the bylines on articles-- a lot of those are credited to the Associated Press. I don't see what you're doing as being any different. CDAN himself, before I stopped reading, would run blinds from Lainey and cite it. And HE'S an attorney (allegedly).
I have some time in the next week. I'll try to research this very issue and get back to you. I'm not an entertainment lawyer. I'm a prosecutor. And no, I'm not Enty.

I counted, and out of the most recent 18 posts on Foxella, 16 are from CDan and the other 2 are from Blind Gossip. ReplyDeleteCDAN is basically a site on its last legs. Enty has definitely sold the website to somebody else, who switched to a proprietary hosting, rather than relying on Blogger.com, as Blogger means cutting Google a share of the ads. That's the only explanation I see for the redesign. They used a free, generic template that favors images in the layout, while most of the blog entries on CDAN, especially the blinds, never got one, and even "Enty" hasn't tried to make use of them for the newer entries.
ReplyDeleteThat would also explain the increased number of blinds in the last year or the emphasis on juicy and disgusting blinds (incest, child abuse...) as they would drive the page views up, and inflate the value of the site for a prospective buyer.
For me, the site is on its last legs. The original Enty may still make the occasional cameo, but the bulk of the content is now based on random gossip posted elsewhere and handled by ghostwriters with zero proofreading, as the guys must get barely paid anyway.
The redesign only made more obvious how shallow and shady the current content is. It was a "Jump the shark" moment for many. We had stayed there by habit, but there's little reason anymore to return, as the clunky and ugly layout just underlines how generic the blinds are now.
Anyway the key for fair use of material from other sites would be to have something distinctive to offer. If most of the interesting text in a blog is taken verbatim from one particular blog, the original blog can have a point.
ReplyDeleteDListed doesn't just copy the BIs from CDAM, Michael K just picks a few ones, copy a few lines from them, and most of the entry is something he wrote on his own, so that's still considered as original content.
AGC Webpages collects all the BIs posted on the web, most likely with the agreement of the websites, and they still drive traffic to them because it's just a static page with a link, and you have to be back at CDAN to post a comment.
So, there's a fine line to maintain to be sure to be out of trouble with takedown notices.
I think the issue is that this site was a blatant rip off of Cdan, including the deep thoughts and readers choice sections (same concepts, different name). I don't blame Enty for sending this site a cease and desist since why should another site make $ off of his/her hard work. Other than a few original Outtie blinds and the real estate and 2 Twitter posts, this site is just leeching off Cdan success. Had it been more original, I don't think there would have been a problem. As Angela commented above, other sites use Cdan material, but they don't post word for word, and they don't base their entire website on reposting that material.

I agree that the Companion site was probably actionable, but it ended for this site which also posts BG blinds and blinds from other gossip sites. In any case, all blinds have links to the original content so it's not illegal.
DeleteThe reposted content is not plagiarism since it is attributed. However, reposting content does violate copyright laws when the amount of it exceeds "fair use". I think this is where the issue started with Enty. Posting all the blinds is not fair use. Posting one blind a day probably is fair use. (I forget how Fair Use is determined in the copyright act. % of the content or number of words...I'll find it and post it.). Either way, Enty has taken steps to protect his copyright, and Google automatically did its thing.
Delete@ medgrl - well, now that Enty has taken action, Outie has the opportunity to further define & personalize her site. She has an eager readership who embrace the site, so that's half the battle.
Delete@Karen Outtie may not be making any money off Enty, but the existence of the site deprives CDAN of page views, ads, and money.
DeleteLet's take an extreme situation, with a website that offers paid content to read (like the Wall Street Journal). Another site just copies their articles and put them online for free. That's a significant loss of income for the site with paid content.

With regard to what The BLS wrote, I have a different take. I'm a former journalist who had articles syndicated. And wrote for a major international magazine.
ReplyDeleteWhen an Associated Press or Reuters or any other syndication article is used, the publication pays a licensing fee.
There is a copyright versus Reasonable/Fair Use issues with using Enty's content. You're allowed to use a little bit of someone's work as long as you attribute it. If you use a lot of it, then you need permission. The percentage is actually broken down in the US copyright act. I'll see if I can find it. Sites post full content from other sites all the time. It doesn't mean that it is legal. However, it is up to the owner of the content to do something about it if they choose to do so.
Enty is obviously okay with other sites reposting his content - especially in the early days - because it promotes his blog.
However, the relationship here between Anarchy and and CDAN is very different and it's pretty easy to see why. It is CDAN's legal right to deny usage of its content to Anarchy.
Outie, you're in his crosshairs. Do your own thing. Post a link to the Enty blinds that are posted on another if you wish. Or ignore the other site entirely. Either way, Enty handled this poorly and it solidified your readership.

ReplyDelete1. I won't go back to CDAN regardless of what happens to this site. It started out because it was an useable site, but now I'm just pissed off. While I understand that CDAN doesn't want any site to post in a way that would limit their income generating ability, there is a goodwill factor that most sites weigh. Perhaps a link to the original source would cause some readers here to go to the CDAN site to see what commenters over there are posting. Once there, they stick around to look at other posts or random photos or whatever. The non-conformist in me hopes that readers here will stop going to that site altogether. But that's an individual decision.
2. I rarely commented on CDAN because of the sometimes nasty tone of some of the commenters. It seems absurd to me that a comment on a silly gossip website can lead to such personal attacks. Anyone who has visited CDAN long enough knows the level of viciousness that occurred over there. The crowd here are nice people - friendly, inviting and (mostly) sane. Look, it's a gossip website. It's supposed to be fun. We aren't curing cancer here. It's a break in the day. We all have opinions based on our own life experience & philosophies and it's nice to express them without being hounded about it. I won't return to the CDAN freak show.
3. I hope Outtie continues this site. I'm fine with discreet ads to help (I'll even click on them from time to time). I didn't come here from CDAN Companion because I'd get CDAN blinds and I won't leave if those are stopped. I like the real estate stuff. I like the newsier stuff. I like the general topic conversations we have. There's a lot on the web to rummage through and plenty to post. I won't click on CDAN links to read an entire post for details, but I'm fine with clicking on other source links, reading the story and coming back here to comment (although it would be easy if the hyperlink opened a new window rather than replacing AG when clicked).
4. Unfortunately, I have no gossip about anything so I can't help there.
5. However Outtie wishes to proceed is fine with me. Internet content is a sticky business. While Outtie could challenge the cease & desist, the financials of that would be prohibitive for her/him. If Outtie decides to close up shop, I'd understand. I won't return to CDAN for any reason, but I sure to hope that I find you all on another site.
I wish agent IT was still here. She'd know exactly what was legal for Outtie to post.
ReplyDeleteOuttie I love this site! I'm so glad I found it. I read CDAN for several years, but after the cluster going on over there - I'll never go back. I enjoy the real estate listings, all the original BIs, and love, love, love the comments. This is my guilty pleasure. Please don't close up shop. I'm totally on board with AG! You're the best! (Your writing is a breath of fresh air, and your Grammar rocks too! ;) )
ReplyDeleteIf Outtie wants to post CDaN blinds using "Fair Use" all they need to do is provide a bit of commentary after the blind even if it's something like "This blind seems awfully familiar to a previously revealed blind from years ago" or "This one seems like a work of fiction and not a real blind". Anything like that is considered fair use since it is a commentary on a published work.

ReplyDeleteLate to the party.. AGAIN. I think this is the nail in the coffin for enty. This isn't really just a cease and desist against Anarchy Gossip, it's a cease and desist to all of us to stop even bothering with the content on that site. Anarchy is the easiest, most accessible scapegoat for the numbers dropping over there and they're obviously grasping at straws at this point. The new layout blows, the content has gotten worse, and they renounced the entire community out of ego. The old site can suck it. I don't need a bunch of shitty rehashed blinds that rarely make sense. Plus, the less annoying and and simply awesome people are here anyway.

ReplyDeleteI'm another fairly long time reader/poster who is ticked off with all the crap that KJE has been pulling. I don't have much more to add that hasn't already been said.
Hang in there, Outie. You've got a fairly large, devoted fan base here and we'll keep reading as long as you want to keep posting.
