Actress Kelly Rutherford, who won a small victory in her custody battle with ex-husband Daniel Giersch when her children were ordered to spend the summer with her in New York, has seemingly lost the war. TMZ reports that at the end of the summer, the children will be retuning to Monaco to live with their father, permanently. A Monaco judge has ruled that the California court that granted Rutherford custody has no jurisdiction over the case. No word yet as to Rutherford's next move.
