Page Six reports that Onion King Nick Loeb scored a preliminary victory in his embryo battle with ex Sofia Vergara. Loeb filed a lawsuit against Vergara back in April demanding custody of their embryos, which he wants to implant via a surrogate. In a preliminary hearing that took place on Tuesday, a judge shot down Vergara's legal team and allowed Loeb's side to move the case forward to trial. Vergara's team still has one more chance to get the suit dropped before it heads to trial.
